Terms and Conditions of Service

Welcome to BBKrate Bombay (“Company”, “we”, “us”, or “our”). These Terms and Conditions of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Customer”, “user”, or “you”), and BBKrate Bombay, concerning your access to and use of our e-commerce platform and website.

By accessing, browsing, or executing transactions on our platform, you acknowledge that you have read, understood, and expressly agree to be legally bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the platform and must discontinue use immediately.

1. Legal Capacity and User Accounts

  • Age Requirement: The platform is intended strictly for users who are at least 18 years of age. By creating an account or transacting on this platform, you warrant and represent that you possess the legal capacity to enter into a binding financial contract under the Indian Contract Act, 1872.

  • Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, including your password and access restrictions on your devices. You accept full liability for all activities executed under your account.

  • Accuracy of Information: You guarantee that all registration and billing data provided to us is accurate, current, and complete. Provision of false, misleading, or obsolete data constitutes a breach of these Terms and may result in the immediate termination of your account.

2. Consent to Electronic Communications

By provisioning your contact information on our platform, you grant explicit consent to receive communications from BBKrate Bombay and authorized third-party service providers.

  • Channels of Communication: Communications may be transmitted via SMS, telephonic voice calls, automated dialing systems, WhatsApp messaging, and electronic mail (Email).

  • Scope of Messages: These communications may encompass transaction updates, logistical tracking, administrative alerts, operational notices, and promotional or marketing materials.

  • Opt-Out Mechanism: You may opt out of receiving promotional communications at any time by utilizing the unsubscribe links provided or by directly contacting us at bbkrate@gmail.com. However, critical transactional notifications necessary to fulfill pending orders will continue to be transmitted.

3. Commercial Transactions and Order Cancellation

  • Payment Representation: When executing a purchase (“Purchase”), you represent and warrant that you have the lawful right to utilize the selected payment mechanism (including credit/debit cards, UPI, net banking, or digital wallets) and that the financial information supplied is valid.

  • Third-Party Processing: We utilize secure, third-party payment gateways to facilitate financial transactions. By submitting your billing data, you authorize us to share this information with authorized third-party processors in accordance with our Privacy Policy.

  • Right of Refusal: BBKrate Bombay reserves the unconditional right to refuse, limit, or cancel any order at our sole discretion. Reasons for cancellation include, but are not limited to:

    • Product unavailability or stock discrepancies.

    • Errors in pricing descriptions or technical system glitches.

    • Detection of suspected unauthorized, fraudulent, or illegal activity by our risk mitigation frameworks.

4. Pricing and Product Representation

  • Typographical Errors: While we endeavor to ensure absolute precision, inadvertent technical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotional offers, and availability may occur.

  • Correction Rights: BBKrate Bombay reserves the right to correct any errors or update platform information at any time without prior notice, even after an order has been submitted or a transaction has been initiated.

5. Prohibited Activities

You are strictly prohibited from using the platform for any unlawful purpose or in violation of these Terms. Prohibited conduct includes, but is not limited to:

  • Engaging in data mining, scraping, crawling, or extracting any content via automated software, robots, or scripts without explicit written authorization.

  • Attempting to breach, bypass, or compromise the security architecture, servers, networks, or host databases of the platform.

  • Introducing malicious software payloads, viruses, Trojan horses, worms, or logic bombs designed to disrupt or damage platform operations.

  • Impersonating any individual, entity, or employee of BBKrate Bombay, or executing transactions under fraudulent identities.

6. Intellectual Property Rights

Legal Notice on Ownership: Unless otherwise explicitly specified, the platform, its underlying source code, database architectures, digital designs, functionalities, graphics, logos, and audio-visual materials are the exclusive proprietary property of BBKrate Bombay.

All materials are protected under the Indian Copyright Act, 1957, Trade Marks Act, 1999, and various other intellectual property and unfair competition laws. No part of the platform or its content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed for commercial purposes without our express prior written consent.

7. Disclaimer of Warranties

The platform and all products sold therein are provided on an "as is" and "as available" basis. BBKrate Bombay disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, to the maximum extent permissible under applicable law.

We make no representations or warranties regarding the absolute completeness, accuracy, reliability, security, or uninterrupted availability of the platform, or that any identified system defects will be immediately rectified. Your use of our services is executed entirely at your own risk.

8. Limitation of Liability

Except where strictly prohibited by statutory laws, BBKrate Bombay, its officers, directors, employees, or agents shall not be held liable for any indirect, punitive, special, incidental, consequential, or exemplary damages, including lost profits, loss of data, or operational downtime, arising out of or in connection with the use of our platform or products.

In any scenario where legal liability is established against the Company, our maximum aggregate financial liability shall be strictly capped at the total amount paid by the customer for the specific product or transaction giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless BBKrate Bombay, its parent entities, subsidiaries, affiliates, officers, directors, and employees from and against any and all losses, liabilities, claims, demands, damages, and expenses (including reasonable attorney fees and legal costs) arising out of or resulting from:

  • Your material breach or violation of these Terms.

  • Your unauthorized or improper use of the platform.

  • Your violation of any third-party rights, including but not limited to intellectual property or privacy rights.

10. Governing Law and Dispute Resolution

These Terms and your relationship with BBKrate Bombay shall be governed by, construed, and enforced in strict accordance with the laws of India, without regard to its conflict of law principles.

Statutory Jurisdiction: Any legal action, lawsuit, arbitration, or judicial proceeding arising out of or relating to these Terms, or transactions executed on the platform, shall be subject to the exclusive legal jurisdiction of the competent courts located in Mumbai, Maharashtra, India.

11. Amendments to the Terms

BBKrate Bombay reserves the right, at its sole discretion, to modify, amend, or update these Terms at any time. It is your statutory responsibility to review these Terms periodically to stay informed of changes. Your continued use of the platform following the publication of revised Terms signals your full acceptance of and agreement to the modified provisions.
